RCA CLAIMS - Procedure

To simplify the case, it is important to take photos on site and to know the details regarding:
        → the vehicles involved: make / type, registration numbers, color, body type, damage location, etc.;
        → those who participated in the event: driver / passenger / witness names, contact details, etc.;
        → the day, time, location, points of localization (names of connecting streets, street / road / block / house number, etc.);
        → the roadway: pavement type, number of lanes, demarcation line, etc.

Because we aim for the correct and rapid settlement of claims, and the payment of well-founded, legal, and proven requests, the AXERIA IARD technical team uses innovative IT technologies in the claims handling process for:
        → claims management;
        → damage assessment and collection of necessary documents for claims file processing;
        → rapid communication with state institutions (ASF, Police, etc.), with legal professionals and technical experts;
        → analyzing the dynamics and reconstructing the accident, regarding the establishment of the causes and circumstances of the event;
        → reading, collecting, and interpreting errors generated by the vehicle’s electronic systems;
        → accessing professional software for auto parts;
        → analyzing service manuals provided by the manufacturer for each vehicle model;
        → analyzing maintenance / claims history in authorized repair networks;
        → voice analysis.

Please take the necessary steps to limit the increase of damages and, as far as possible, take measures to transport and store the damaged vehicle in optimal conditions, to avoid degradation, further damage, fire (by starting an engine with fuel leaks), or theft of certain parts.
AXERIA IARD does not compensate for damages incurred after the event, and any risk incurred will be compensated only once, regardless of whether this is done under the at-fault party’s RCA insurance policy or under your own RCA policy, in the case of purchasing the auxiliary claims management service (direct settlement).
Obtaining undue or multiple material benefits from insurance, by procuring false or unreal documents or fiscal invoices, delayed declaration of the accident date, declaration of inaccurate data, etc., as well as misleading AXERIA IARD in any form, is punishable according to the Penal Code and will result in the restitution of the amount received (if payment has been made), and the guilty person will be held criminally liable according to current legislation, and will pay the costs and damages occasioned by the respective dispute.

RCA CLAIMS - INCIDENT OCCURRED AND RESOLVED OUTSIDE ROMANIA

The procedure differs depending on the country where the accident occurred.

To avoid subsequent complications, documents signed by the Axeria IARD insured must be in a language known to them or translated into Romanian. It is presumed that the signatory of the documents knows the content, and an error of law does not exempt from liability.

The Green Card document is an international insurance document issued in the name of the national motor bureau, based on which the owner/user/driver of the vehicle for which the document was issued is insured for civil liability for damages caused by the respective vehicle, in accordance with the legislation of each state for which the insurance document is valid.

If the event is covered by an AXERIA Green Card insurance (attached to the RCA insurance) and occurred outside Romania, the insured must notify Axeria IARD representatives as soon as possible, as follows:

BY PHONE (Monday ÷ Friday, 09:00-18:00) – by calling the Call Center Service, a Customer Care representative will provide you with the necessary support for a complete and correct notification;

Email – send a message to greencard@axeria-iard.ro, mentioning the event details, material damages and/or bodily injuries caused, and who is at fault, and if necessary or requested, a claims specialist will contact you to clarify all aspects.

Carefully complete all sections of the Amicable Accident Report form or wait for the Competent Authorities to draw up the documents recording the circumstances of the accident, if the legislation of the respective country requires it.

Hand over a copy of your Green Card insurance document, registration certificate (talon), driver’s license, identity card, etc., to the other driver.

RCA CLAIMS - DIRECT SETTLEMENT

If you are involved in a road incident, are the injured party, and are a beneficiary of the auxiliary claims management service by RCA insurers for their own insureds, and the cumulative conditions are met:

→ the auto accident occurred in Romania;
→ the vehicles involved in the auto accident are registered in Romania;
→ damages are caused exclusively to vehicles (only material damages, no bodily injuries);
→ both vehicles involved in the auto accident have valid RCA insurance at the time of the event;
→ damages exclude bodily injuries,
then you can follow the standard procedure for resolving a claims file, receiving all the support you need from us, without having to resort to the services offered by the at-fault party’s insurer.

At the time of the assessment, to open the claims file, the insured must present the following documents:
the mandatory RCA insurance policy of the insured vehicle – copy;
→ the identity document of the injured party or their representative (ID card) – original;
the driver’s license of the injured driver (if the vehicle was driven at the time of the event) – original;
→ registration certificate (vehicle registration document) of the damaged vehicle; – original;
the identity document (ID card / Bulletin) and driver’s license of the at-fault driver (if possible) – copy;
the mandatory RCA insurance policy of the at-fault vehicle (or at least proof of its existence) – copy;
Amicable Accident Report or Document issued by Authorities (Police / Fire Department Report, Repair Authorization, Annex 2, etc.) – original;
power of attorney (legal entity) / notarized power of attorney (natural person), if the driver presenting for the assessment is not the owner of the damaged vehicle – original;
other documents, depending on the event that occurred.
ATTENTION!!! In case of processing the claim based on the Amicable Accident Report, the presence of both drivers and both vehicles involved in the road incident is recommended at the assessment.
Direct settlement does not affect the right of the person harmed as a result of a car accident caused by an RCA-insured vehicle to exercise direct action to recover the damage caused against the RCA insurer of the person at fault for the car accident.
During the investigation, depending on the content of the documents presented, other documents may be requested from the injured party to complete the claims file:

→ additional statements and/or accident sketch;
→ documents proving ownership of the vehicle, if it is not registered/fiscally recorded by the new owner;
→ photos of the damaged vehicle;
→ passport copies, etc.

Notification

When assessing damages, the presence of both drivers and both vehicles involved in the road incident is recommended. Claim notification can be made if you have the following documents at hand:

Documents:

  • at-fault vehicle’s insurance policy;
  • identity document (ID card/bulletin) of the person making the notification;
  • registration certificate (talon)/identity card of the damaged vehicle;
  • driver’s license of the injured driver;
  • amicable accident report or documents issued by authorities (police/fire department/etc.);
  • details of the damaged vehicle’s owner;
  • other documents depending on the event that occurred.
